Regulations for Sponsorships

Art. 1 – Purposes

  • This regulation governs sponsorship activities by third parties for what concerns the organization of the International Short Film Festival MED-LIMES “At the borders of the Mediterranean”, Images and stories from the borders of the Mediterranean  . The FONMED – “ South Foundation for Cooperation and Development in the Mediterranean ” delegates the company Medicert S.r.l. for the realization of all operational services and the acquisition of any sponsors.
  • Individuals applying for sponsorship declare that they know, accept and share the Foundation’s principles and aims published on the website fonmed.it
  • The FONMED, in the person of the President, can revoke, at its sole discretion and at any time, the sponsorship contract signed with third parties if the conditions are not met.

Art. 2 – Definitions

    2.1. For the purposes of this Regulation:

  • a) by “sponsorship contract”: a contract with corresponding services by which a party (sponsor) undertakes to pay a sum of money, to supply goods or services or to carry out works in favor of the other party ( events, initiatives or projects, the possibility to advertise, in appropriate spaces, the name, brand, image, activity, products or services or similar, or to distribute products or services on a promotional basis, in the manner provided by the contract • obligation of means and not of result, therefore it must have been the realization of the event, initiative or project deduced in the contract from the actual return of image;
  • b) for “sponsors” or “sponsors” the subject who, in order to increase the reputation of their distinctive signs, signs the sponsorship contract;
  • c) for “sponsored” or “sponsee” the person who renders the provision of means consistent in making available the possibility of advertising the distinctive signs of the sponsor in the context of their own events, initiatives or projects;
  • d) “advertising space”: the physical or digital space or any other medium capable of providing information, made available to the sponsor,
  • e) for financial or pure sponsorship in which the sponsor in exchange for the right to exploit space for advertising purposes, is limited to conferring funding, while other activities are carried out – such as the execution of works or services of services to different subjects;
  • f) for technical sponsorship in which the sponsor, in exchange for the right to exploit spaces for advertising purposes, performs work, provides services or provides goods.
Art. 3 – The Sponsor The following subjects may take the form of sponsors: – natural persons; – legal persons, whether or not for profit or commercial purposes; – non-profit associations.
Art. 4 – Object of Sponsorship The sponsorship contract can have as its object: – the supply of material or goods / equipment; – the provision of a service provision; – the provision of a cash contribution.
Art. 5 – Sponsorship methods Sponsorship initiatives can take, by way of example and not exhaustively, the following forms: – presence of the sponsor’s logo on official communication materials (chamber publications, event program, posters, posters) , press kit, multimedia channels, etc.) – participation in the highlights of the presentation of the event: press conference, inaugural event, etc .; – right of association of the image of the Sponsor Company to that of the sponsored event for its own advertising activities; – spaces on correspondence; – spaces for the event; – spaces on the company website.
  Art. 6 – Sponsorship levels Participation in the MED-LIMES International Short Film Festival “On the Mediterranean’s borders” consists of three different levels of involvement specified below: It is also possible to collaborate in the organization of the initiative as a technical sponsor for the supply of materials or to contribute to living costs such as dinners, coffee breaks.

From 0 to 1000.00 euros – Silver Sponsor

    This formula provides visibility of the lower level of the logo through:

  • Web pages, dedicated sites, social networks, newsletters, event mailing lists;
  • Illustrative brochure of the event;
  • Promotional poster design
From 1000.00 to 3000.00 euros – Gold Sponsor

    This formula provides visibility of the lower level of the logo through:

  • Web pages, dedicated sites, social networks, newsletters, event mailing lists;
  • Illustrative brochure of the event;
  • Promotional advertising;
  • Possibility to add own information and promotional materials
  • Roll-up, flyer and banner.
Over 3000.00 euros – Main Sponsor

    This formula provides visibility of the lower level of the logo through:

  • Web pages, dedicated sites, social networks, newsletters, event mailing lists;
  • Press releases;
  • Illustrative brochure of the event;
  • Promotional advertising;
  • Possibility to add own information and promotional materials
  • Roll-up, flyer and banner;
  • Television footage;
  • Possibility to set up corner boxes, show points.
Art. 7 – Sponsorship contract Sponsorship management is regulated through the signing of a specific contract in which, in particular, are established:
  1. a) the subject of the contract;
  2. b) the value of the sponsorship;
  3. c) the form of consideration and payment methods;
  4. d) the duration of the contract;
  5. e) the commitments and / or obligations of the sponsored subject – sponsee;
  6. f) forms of distribution of the distinctive signs of the sponsor by the sponsored subject -sponsee;
  7. g) regulation of the use of logos, brands or distinctive signs of the sponsor;

 

  1. h) the commitments and / or obligations of the sponsor and the way the logo of the sponsored subject is managed – sponsee where required;
  2. i) any right to “exclusive”;
  3. j) the recess;
  4. k) the non-fulfillment and termination of the contract;
  5. l) the resolution of disputes related to the performance of the contract;
  6. m) final contractual costs and provisions.

The sponsorship contract is signed by the sponsor and by Medicert S.r.l. With the sponsorship contract the use of the “advertising space” indicated in the specifications is also authorized.

Art. 8 – Regulation of the general exclusivity or of the exclusive commercials 8.1. The company Medicert srl can define the relationship with the sponsor on the basis of general or commercial exclusivity clauses if it considers that these contractual provisions can be useful to solicit competitive profiles aimed at finding more resources or presenting more significant sponsorship proposals. 8.2. In relation to the provisions of the preceding paragraph 1:

  1. a) the general exclusivity clause involves the formalization of the relationship with a single subject as a sponsor;
  2. b) the commercial exclusivity clause implies the formalization of several sponsorship relations with subjects as sponsors, each identified as the main counterpart and unique for a specific product category or activity.

8.3. The company Medicert S.r.l. highlights the existence or absence of general or commercial exclusivity clauses in the procedures prior to the conclusion of a sponsorship contract, specifying any criteria for evaluating competing proposals. 8.4. In any case, the possible inclusion of exclusivity clauses in the sponsorship contracts does not imply incompatibility with other initiatives involving third parties, such as sponsorship or awareness initiatives related to spaces, goods and issues of collective interest.

Art. 9 – Use of proceeds and cost savings deriving from sponsorships The sums received as compensation from sponsorships will be used to finance the activities of FONMED – “ South Foundation for Development and Cooperation in the Mediterranean < / em> “, favoring the promotion, dissemination and realization of the event, program, initiative or activity sponsored. The services covered by the sponsorship contracts / collaboration agreements / agreements governed by this regulation are subject to the current provisions on tax matters.
Art. 10 – Processing of personal data

  1. a) Personal data collected in application of this regulation will be processed exclusively for the purposes set out therein.
  2. b) Individuals concerned have the right to exercise their rights recognized by Legislative Decree no. 196/2003 and s.m.i. and of the European Privacy Regulation (GDPR 2016/679).
  3. c) The Data Controller is Medicert S.r.l. in the person of the legal representative who adopts the preparatory acts for sponsorship.
  4. d) The data are processed in compliance with current regulations by the employees of Medicert S.r.l. required for the application of this Regulation.
  5. e) The data may be communicated and / or disseminated to public or private subjects in relation to the purposes of the regulation.
Art. 11 – Referral For each aspect relating to the subject matter and the contractual object that does not however find explicit discipline in this regulation we refer to:

  1. a) for the profiles of contractual regulations, the provisions of the Civil Code and special regulations on the subject;
  2. b) for the use of trademarks and distinctive signs to Legislative Decree no. 30/2005 and s.m.i., as well as other specific legislation on the subject.

Partnership Regulation

Art. 1 – Purphose

  • This regulation governs the partnership activity of third parties with regard to the organization of the International Short Film Festival MED-LIMES “At the borders of the Mediterranean”, Images and stories from the borders of the Mediterranean . The FONMED – “ South Foundation for Cooperation and Development in the Mediterranean </ em>” delegates the company Medicert S.r.l. for the realization of all operational services and the acquisition of possible partners.
  • Those who request a partnership declare that they know, accept and share the Foundation’s principles and aims published on the website fonmed.it
  • The FONMED, in the person of the President, can accept and revoke, at its sole discretion and at any time, the partnership contract stipulated with third parties if the conditions are not met.
Art. 2 – Definitions For the purposes of this regulation we intend to involve in the organization of the International Short Film Festival MED-LIMES “At the borders of the Mediterranean” partners for the supply of goods, resources and resources, guaranteeing a return of image and enhancement of their brand. The Partnership is the formula for establishing and coordinating relationships of mutual collaboration within the event. The partnership is therefore also to be understood, on the part of the third party recipients, the contact channel to be privileged and pursued to propose proposals for joint actions to the Organization of the Review.
Art. 3 – Partner They can apply for the partnership: – Recognized and non-recognized cultural, social and arts promotion associations; – Social Cooperatives; – Foundations; – On-line and off-line information bodies. Any other organization not included in the exemplification first exposed may still advance its application. The organization of the Review reserves the right to verify its congruence with the final aims of the partnership as well as with the forms of association recognized by the state system in force.
Art. 4 – Partnership Object The Partnership contract can refer to: – the supply of material or goods / equipment; – the provision of a service provision.
Art. 5 – partnership way The partnership modality is aimed at clearly guaranteeing the subjects that come into contact through a univocal and transparent procedure. Partners will be guaranteed wide visibility through:

  1. Participation and involvement of our managers during the days of the event.
  2. The exposure of the brand and logo on all channels and communication materials such as:
    • Festival site;
    • Catalogs of the event;
    • Posters
    • Video presentation material of the Review;
    • Promotional materials and merchandising (folders, shoppers, presentations, totems, roll up,);
    • Billboard
  3. Communication campaigns on the main media (including online) and on social media
Art. 6 – Partnership Contract The management of the partnership is regulated through the signing of a specific contract in which, in particular, they are established:

  1. a) the subject of the contract;
  2. b) the duration of the contract;
  3. c) the commitments and / or obligations of the subject requesting the partnership;
  4. g) regulation of the use of the partners’ logos, trademarks or distinctive signs;
  5. h) the commitments and / or obligations of the partner and the way the logo of the subject is managed;
  6. i) any right to “exclusive”;
  7. j) the recess;
  8. k) the non-fulfillment and termination of the contract;
  9. l) the resolution of disputes related to the performance of the contract;
  10. m) final contractual costs and provisions.

IThe partnership contract is signed by the partner and FONMED – “ South Foundation for Cooperation and Development in the Mediterranean </ em>”. With the partnership contract the use of the “advertising space” indicated in the specifications is also authorized.

Art. 8 – postponement For each aspect relating to the subject matter and the contractual object that does not however find explicit discipline in this regulation we refer:

  1. a) for the profiles of contractual regulations, the provisions of the Civil Code and special regulations on the subject;
  2. b) for the use of trademarks and distinctive signs to Legislative Decree no. 30/2005 and s.m.i., as well as other specific legislation on the subject.

Regulations for the request for Moral Sponsorships

Art. 1 – Purphose This regulation governs the activity of request for the granting of moral support by FONMED – “ South Foundation for Cooperation and Development in the Mediterranean” towards public and / or private bodies within the scope of organization of the International Short Film Festival MED-LIMES “At the borders of the Mediterranean”, Images and stories from the borders of the Mediterranean.
Art. 2 – Definitions

  • The patrocinio is configured as a certificate of appreciation and moral adhesion to the social and cultural principles of the International Short Film Festival MED-LIMES “At the Mediterranean borders”, Images and stories from the Mediterranean borders </ em> promoted by FONMED – “ South Foundation for Cooperation and Development in the Mediterranean” .
  • The granting of the sponsorship by public and / or private bodies is exclusively free of charge and can not imply commitments, charges or obligations for the granting of any financial contribution, ordinary or extraordinary, to the FONMED, nor the provision of support and / or the assumption of other obligations or the sharing of organizational costs of the events
  • Patronage is exercised by applying the name and the associative / institutional logo in the communication and dissemination material of the initiative (eg posters, posters, leaflets, publications, etc.) and on any training material.
Art. 3 – Il Patrocinio morale Il Patrocinio è discrezionalmente richiesto sulla base di decisione insindacabile dalla Fondazione ad enti ed istituzioni pubbliche o private che contribuiscano a promuovere, direttamente o indirettamente, l’immagine o le attività della FONMED, ovvero che siano di rilievo culturale, sociale o scientifico, purché coerenti con i principi dello Statuto.
Art. 4 – Method of requesting moral patronage

  • Patronage can only be requested by public or private bodies, which guarantee the correctness, reliability, authority, credibility, which pursue or have a purpose / object / purpose of a social, cultural or scientific nature and that do not fall into conflict situations. interests of any kind with the FONMED.o moral…
  • Patronage is not justified if the following criteria are not respected by third parties at least:
  • consistency and relevance of the object with the institutional and statutory purposes of FONMED;
  • absence of elements that can damage and obscure the image of the FONMED.
  • Entities and institutions not coherent with the institutional and statutory purposes of the FONMED or political parties and / or organizations, however named, which represent specific categories or social forces, for the sole purpose of propaganda or proselytism, or for funding of their organizational structure they can not constitute subjects to whom the grant of moral patronage can be requested.
  • In any case, the FONMED, in full autonomy and at its own unquestionable judgment, remains in the person of the President pro tempore, can refuse or revoke the patronage, without anything being due to any
